My Holland Casino

1.1 My Holland Casino, the Website and the Services are provided by Holland Casino N.V. (‘Holland Casino’), registered with the Trade Register under number 68662289, having its registered office in The Hague and its principal place of business at Neptunusstraat 71 (2132 JP) in Hoofddorp.

1.2 The correspondence address of Holland Casino is PO Box 355, 2132MK, Hoofddorp. The email address of Holland Casino is service@hc.nl.

In these Terms of Use (“'Terms of Use”') the terms and expressions used below are defined as follows:

• Services: the services offered to the User in My Holland Casino. Favorites Card(s): the various card types of the Favorites Loyalty Programme of Holland Casino.

• Favorites Programme: Holland Casino's loyalty programme for guests aged 24 and over, whereby a guest is granted privileges based on their card type.

• Xperience Card: the card for guests of Holland Casino aged 18 to 23.

• User: a natural person who makes use of the Website and Services, by means of a User Account or otherwise.

• User Account: The personal account created by User on the Website for the purpose of using My Holland Casino and the Services offered therein.

• Infrastructure: the technical (ICT) infrastructure required for the use of the Website and the Services.

• My Holland Casino: the personalised protected online environment accessible through the Website.

• Points: points saved on a Favourites Card.

• Access Method: the (combination of) email address and password chosen by User to provide access to the User Account.

• Website: the website hc.nl for visitors to Holland Casino Establishments.

3.1 These Terms of Use apply to all agreements and (legal) acts in the context of the use of the Services and the User Account by the User. These Terms of Use do not affect the applicability of other (general) terms and conditions (if any).

3.2 In order to create a User Account and use the Services, the User must first agree to these Terms of Use. User is not permitted to create a User Account and make use of the Services if User has not accepted the Terms of Use.

3.3 Holland Casino may unilaterally amend these Terms of Use. Holland Casino will inform a User of amended Terms of Use by posting the amended Terms of Use on the Website and/or in My Holland Casino and/or sending the amended Terms of Use by e-mail. If a User continues to make use of the Services and the User Account following such change in the Terms of Use, the User shall be deemed to have accepted the amended Terms of Use.

4.1 To create a User Account, one must be 18 years of age or older.

4.2 The User guarantees the correctness and completeness of all information provided by the User and is responsible for incorrect, incomplete or outdated information

4.3 It is not permitted to create a User Account in the name of another (fictitious) person.

5.1 User is responsible for keeping the Access Medium secret. Misuse of the Access Medium is at the risk of the User.

5.2 If User knows or has reason to suspect that his/her Access Device has been misused or could be misused by unauthorised persons, for example in case of loss, theft or other irregularities, User shall be obliged to inform Holland Casino thereof.

6.1 Holland Casino is not responsible for and does not bear the risk of any infrastructure not under its control that is required for the use of the Website, My Holland Casino or the Services.

6.2 Holland Casino shall endeavour to keep the Infrastructure under its control available for the use of the Website, My Holland Casino or the Services by Users within the times indicated by Holland Casino. However, Holland Casino makes no guarantee as to the actual availability of the Website, My Holland Casino or the Services.

7.1 The User is only allowed to use the Services via his own User Account.

7.2 Without prejudice to the other conditions mentioned in these Terms of Use, the use of the Services by the User may not:

• Be based on untruths and/or be misleading;

• In any way violate the rights of Holland Casino or third parties, including intellectual property rights or rights relating to the protection of privacy;

• Violate any law, regulation, ordinance, code or other applicable regulation;

• Contain viruses, Trojan horses, worms, bots or other software which may damage, render unusable or inaccessible, erase or misappropriate any computer work or data, or which are intended to circumvent technical protection measures of the Website and/or My Holland Casino and/or Services and/or Holland Casino's computer systems;

• Are intended to gain unauthorised access to the Website, My Holland Casino, User accounts of anyone other than Users, Holland Casino's computer systems and/or data files;

• Are of a commercial nature; and

• Be otherwise unlawful in any way towards Holland Casino and/or a third party.

7.3 All (intellectual) property rights to the content of the Website and/or My Holland Casino and/or the Services are owned by Holland Casino and/or its licensors.

7.4 The User is not allowed to use the Services and accept the Terms of Use if the User:

• Has not reached the age of 18 years;

• Is not in possession of a valid identity document;

• Is (temporarily) excluded from the provision of Services by Holland Casino (entry ban) or is subject to any other restrictive measure, for example, pursuant to (i) Holland Casino's policy on the prevention of gambling addiction, (ii) the customer due diligence obligation under the Money Laundering and Terrorist Financing Act, or (iii) Holland Casino's house rules.

8.1 The information provided through My Holland Casino with respect to gambling addiction and prevention is informative in nature only. Holland Casino is not liable for any actions or decisions taken by Users on the basis of this information. For medical or psychological advice, Users should contact a qualified counsellor.

8.2 Where a User submits a request via My Holland Casino to set a time-out, visit restriction or entry ban, a maximum processing time of a number of days applies. During this processing time User remains fully responsible for his/her own behaviour and access to Holland Casino. During this period Holland Casino shall not be liable for any damage or consequences arising from the fact that the measure has not yet been actively processed.

8.3 Holland Casino reserves the right to require additional verification of restrictive measures or sensitive requests before processing the request.

9.1 Users may delete their User Account for My Holland Casino at any time.

9.2 Removal of the User Account is done via ‘My Details’ in settings on My Holland Casino.

9.3 If Holland Casino suspects (identity) fraud, deception, unlawful use or abuse of My Holland Casino and/or the Services, or if, in the opinion of Holland Casino, My Holland Casino and/or the Services are being damaged, Holland Casino shall be entitled to terminate the User Account at any time, without being liable for any form of refund or compensation. In such cases Holland Casino may report this to the police.

9.4 Holland Casino is entitled at all times, at its sole discretion and without giving reasons, to refuse the creation of a User Account, to refuse (in whole or in part) the use of Services or to suspend the provision of My Holland Casino and/or the Services without giving reasons, to terminate the User Account, without being liable for any compensation.

9.5 Holland Casino shall inform Users of the termination of My Holland Casino, the User Account or the Services at least three months in advance by email or by means of a notice on My Holland Casino or the Website, unless special circumstances justify a shorter notice period.

10.1 Holland Casino is the responsible party for the processing of personal data collected within the framework of My Holland Casino and the Services. The processing is registered with the Personal Data Authority.

10.2 Holland Casino respects the privacy of Users. Holland Casino processes personal data of Users in accordance with the following terms and conditions.

10.3 Holland Casino collects and processes Users' personal data as part of My Holland Casino for the following purposes:

• to create a personal profile based on the personal data collected about Users and contact preferences;

• to offer, implement and improve My Holland Casino and the Services;

• to send Users, if they so choose, general information about Holland Casino's products and services;

• to inform Users, if they so choose, about specific products and services of Holland Casino on the basis of personal data collected about Users (such as saved or spent points) and the personal profile compiled;

• to send Users, if they so choose, messages within the framework of, for instance, restaurant or poker bookings;

• to carry out actions and promotions in which Users can participate;

• for conducting market research and improving the services of Holland Casino.

10.4 Holland Casino obtains Users' personal data as part of My Holland Casino in various ways, such as when you create a User account for My Holland Casino; Holland Casino may then process your name, address, place of residence, date of birth, photograph, e-mail address, telephone number, Favorites Loyalty number and Xperience Card number;

10.5 Holland Casino may share Users' personal data with service providers performing certain processing activities on behalf of and under the responsibility of Holland Casino. Holland Casino may make Users' personal data available if it is required to do so by law, if this is necessary to prevent fraud, or if there is another necessary and legitimate basis which exceeds the privacy interests of Users, such as the security of Holland Casino and the safety of its employees. Holland Casino will not provide your data to third parties for commercial purposes, unless you have given your explicit consent.

10.6 A User has the right to request to see, correct or delete personal data concerning them. A User may send a specified request to the Holland Casino correspondence address stated in article 1 and specify to which personal data their request relates. If Holland Casino is unable to determine (in full) to which personal data a request for inspection, correction or deletion relates, Holland Casino may ask the User to specify their request. In this event Holland Casino will suspend the implementation of the request until the User has provided Holland Casino with the (further) specification.

10.7 Holland Casino aims to provide accurate and up-to-date information on personal advantages, loyalty points and vouchers in My Holland Casino, but makes no guarantees as to its completeness or accuracy. No rights can be derived from the information displayed.

11.1 Holland Casino shall not be liable for any direct or consequential damages or costs incurred by the User or third parties, on any grounds whatsoever, as a result of use of the Website, the User Account or the Services, including damages resulting from:

• any typographical, printing or typesetting errors;

• termination or modification of any Service; or of the User Account;

• the (temporary) unavailability of the Website, MijnHollandCasino and/or the Services;

• (a) failure(s) of third party(ies);

• Infrastructure not under the control of Holland Casino, unless the damage in question is caused by intent or wilful recklessness by the management of Holland Casino.

11.2 Any User who breaches these Terms of Use, makes unlawful use of the Website, the User Account or the Services, or otherwise acts unlawfully within the framework of the use of the Website and/or Services, shall be liable for all loss resulting therefrom to Holland Casino and any third party, without prejudice to Holland Casino's other rights.

11.3 The User indemnifies Holland Casino and any third parties working on its behalf against all claims by third parties for all damages and costs arising in any way from the use of the Website, the User Account or the Services, or from the User's failure to comply with its obligations under these Terms of Use.

12.1 If one or more provisions of these Terms of Use are void or annulled, Holland Casino shall be entitled to stipulate one or more replacement provisions that are as close as possible to the nature and tenor of the void or annulled provision without being void or annullable itself.

12.2 In cases not covered by these Terms of Use, a decision will be made by Holland Casino.

12.4 These Terms of Use, all agreements and (legal) acts between Holland Casino and its Users shall be governed by Dutch law. The court in Haarlem, the Netherlands shall have exclusive jurisdiction over any disputes arising from these Terms of Use.
